从广义上理解的羁押必要性审查包括采取和继续羁押两阶段,对羁押必要性的理解离不开对羁押功能的认识。功能即有用性,是采取和继续羁押的依据,缺失了功能性的羁押不再是必要的。未决羁押具有的程序保障、社会防卫、特定防卫、安抚、推进侦查等功能的定位可以为羁押必要性审查在程序和内容上提供指引。

As generally interpreted, the necessity of detention includes inflicting and continuing detention.To understand the necessity of detention, we have to understand the function of detention. Function means effectiveness, which is the base for inflicting and continuing detention. It＇s not necessary if the detention is not effective. The functions of pretrial detention include procedural protection, social defense, specific defense, pacification and promoting the investigation. All these functions will provide guidance on reviewing the procedures and contents of the necessity of detention.
