摘要
在著作权各项权利中,复制权是极其重要的一项权利。但是,复制权的享有必须受到"合理使用"制度的限制。现今各高校的学生盛行复印教学资料来满足学习需要,所依据的理由就是"合理使用"。文章运用"三步检验法"分析,只要包含若干重点章节的复制就超出了"合理使用"限度。为防止复印侵权行为的发生,在我国主要高校应建立著作权管理机构,以"先行先试"为著作权的完善提供经验。
Among all the rights of copyright,the right of reproduction is a very important one,but it should be limited by fair use,which is the basis for students in universities to use reproductions to meet their needs.In this article,we will use a method called " three stepped test" to confine the scope.If reproductions contain several important sections,they will be regarded as surpassing the limitation of fair use.To prevent such actions of torts,our country should establish an organization to manage the copyright in universities,so as to provide better experiences by adopting the method of " first conduct,first try".
