摘要
从思想观念、制度结构、主体行为三个维度对收容遣送制度变革的动因和障碍进行经验总结,对于进一步推动中国社会管理制度创新具有重要的启示和借鉴意义。具体来说,收容遣送制度变革的动因主要包括:执政理念更新与社会观念进步、法律冲突与制度异化、公众参与的"倒逼"效应。收容遣送制度变革的障碍主要包括:以国家为中心的秩序观、制度路径依赖的制约、执法者的行为失范。变革的启示主要包括:观念变革是制度改革与创新的根本前提,制度结构优化是制度改革与创新的核心途径,行为改善是制度改革与创新的关键诉求。
This paper analyzed the motivation and obstacle of internment and repatriation institutional change from the viewpoints of concept, institutional structure and subject behavior. Specifically, the motivations include: the ruling idea renewed and the social concept advanced, the law conflict and the institution alienation, the "reversed" effect of public participation. The obstacles include: the order view of taking nation as the center, the restriction of institutional path dependence and the behavior anomie of law enforcer. The enlightenments mainly include: concept change is the fundamental premise of institutional reform and innovation, institutional structure optimization is the core path of institutional reform and innovation, and behavior improvement is the key demand of institutional reform and innovation.
