摘要
本文以历史文献为基础,对发生在20世纪90年代前期的杰弗里斯诉(纽约城市学院校长)哈勒斯顿案进行梳理,叙述了因杰弗里斯发表仇视语言所引发的校内冲突及诉讼过程,据此探讨学术自由的边界。本文认为,现代美国大学与社会的联系不断深入,大学教师不同身份之间的界限逐渐模糊,加大了学术自由问题的不确定性和复杂性,从而使任何企图人为划定学术自由的可能性化为泡影。
Based on rich historical documents, this article systematical reviews the case of Jeffries v. Harleston, which took place in 1990s. Tracing the conflicts inside the City College of New York and the influential lawsuit caused by Jeffries; hate speeches, it discusses the limits of academic freedom. The authors argue that, the tighter the connections between modern American universities and communities around them, the more vague the boundary between various identities of university faculty. Because there are more uncertainties and complexities about academic freedom, it is impossible to define this concept artificially.
