政府与市场关系的法律调整

Legal Regulation in Relation of Government and Market

"政府与市场的关系"是社会科学领域的基本问题,基于社会经济领域的"双向运动",应客观看待政府与市场的功用,并结合"两个失灵"辩证施治;同时,基于资源配置系统中的"二元配置"以及我国突出的行政干预过多问题,应特别强调转变政府职能,简政放权,充分保护市场主体的经济自由权。为此,应加强法律规制,通过转变立法的思路、结构和内容,来提升各类主体能力以及整体经济治理能力,强调既要遵循"司马迁定理",又要破解"黄宗羲定律",从而全面推进国家的经济法治建设。

＂the relation between government and market＂ is the basic question in social sciences field. Based on the ＂ bidirectional motion＂, combining ＂two failure＂ dialectical administration, we should see government and market＇ s function objectively. At the same time, based on the ＂two-way layout＂ in the resource allocation system, and our prominent problem of too much administrative intervention, we should strengthen transforming the government function, simplifying administrative procedures, and delegating powers to lower levels, and so protect economic freedom right of main market players. Therefore, we should strengthen law regulation, and transform thinking, construction and content of legislation, to improve all kind of subjects＇ ability and economic governance ability on the whole. We should both observe ＂Sima Qian theorem＂ and break ＂Huang Zongxi Law＂, so as to promote our economy and law construction.
