对我国商业秘密应否纳入边境保护范围的思考--以安全与自由价值为考量视角

Reflection on Whether Trade Secrets should be Included in Border Protection in China:From the Perspective of the Value of Safety and Freedom

商业秘密是否应纳入知识产权边境保护的范围,各国立法存在差异,理论界也存有不同认识。我国知识产权边境保护的范围是否应扩大到商业秘密,可从知识产权边境保护制度的价值层面进行探讨。知识产权边境保护制度体现了贸易自由与秩序安全的价值所在,商业秘密纳入知识产权边境保护范围符合知识产权边境保护制度的价值追求。基于商业秘密的自身特征以及进出口贸易中所涉商业秘密比重的增加,侵犯商业秘密的现象呈日益严重的趋势,出于安全和自由价值考量,我国商业秘密应纳入边境保护的范围。

There exists difference in national legislation and theorists whether trade secrets should be included in the scope of border protection of intellectual property. It can be discussed from the perspective of value of trade secrets that trade secrets should be incorporated into the border protection. The border protection system of intellectual property reflects the trade freedom and order safety value. It is in line with the legal system of the pursuit of value that the trade secrets is included in the scope of border protection of intellectual property. Trade secrets should be incorporated into the border protection in China, taking into account several factors based on safety and freedom value, the characteristics of trade secrets itself, the increased proportion of trade secrets in import and export trade, and the serious trend of violation of trade secrets.
