违反法定程序的诉讼法律后果——评《行政诉讼法修正案(草案)》的“违反法定程序”条款

行政程序具有保障当事人权利、约束行政权的运行、提高行政机关效率的多种功能。我国法定程序的范围应包括法律、法规、规章和具有外部效力的行政规范性文件规定的程序规则,在例外情况下还包括正当法律程序原则。在我国行政程序法典未制定之前,应修改《行政诉讼法》有关违反法定程序的诉讼法律后果的规定,根据程序违法的严重程度以及程序规则在行政行为中的地位与作用来重新设计梯度式的诉讼法律后果,建立系统的责任追究制度,从救济法的角度推进行政程序制度的完善,从而促进程序法治秩序的建立。

Administrative procedures have a series of functions such as the protection of the rights of parties, the restriction of administrative power operation and the promotion of administrative efficiency. In our country, the legal procedures consist of the provisions of procedure in law, administrative rules, regulations and normative documents, and the principle of due process in exceptional cases. The legal consequences of the violation of the legal procedures in the Administrative Litigation Law should be modified before the Administrative Procedure Law is made. It is necessary to design differen litigation legal consequences which are based on the severity of the violation and the status and functions of the procedure rules in the administrative actions. The system of administrative accountability should be made and administrative procedures should be improved from the perspective of relief act, thereby rule of procedure law is established.
