刑事诉讼中责令退赔问题的几点思考

被害人在刑事程序中提起附带民事诉讼时,法院能否适用责令退赔?或被害人未提起刑事附带民事诉讼,而是在责令退赔后,提起民事诉讼,法院能否受理?面对责令退赔与民事诉讼的撞车现象,如何将责令退赔与民事诉讼有效衔接呢?从责令退赔的内涵及更好地保护被害人利益的角度出发,阐述在被害人提起刑事附带民事诉讼时,不应直接适用责令退赔。如果被害人在责令退赔后,又提起民事诉讼的,从保护被害人利益角度,原则上应予受理,只有对个别情形,基于效率原则,才予以禁止。

Where the victim files a civil action after the court-order restitution, the said incidental civil action should be accepted in principle when it comes to protecting the victim＇s benefits; prohibition of such practice is only case-specific for the sake of efficiency.
