摘要 "显化"是指原文本的隐含信息在翻译时得到明晰化。作为翻译普遍特征之一,目前针对显化的讨论主要集中在少数双语平行对比的文学译本比较,法律尤其是涉海法律英译领域较少论及。本文以《中华人民共和国海商法》英译为例,对海商法英译中的显化表现进行探讨,认为由于法律和文学文本的差异,目前基于文学翻译的显化分类并不能完全适用于海商法英译。海商法英译的显化体现在语言功能和法律功能两个层面。语言功能上的显化类似文学文本的显化类型;法律功能上的显化则表现在文本格式显化、文本特征显化和文本意图显化。 Explicitation refers to a course of embodying in the translation the information implicitated or hidden in the source text. Research on explicitation as one of the "translation universals", is mainly focused on comparative analysis of several language pairs in terms of literary translation. Little attention is paid to explicitation in the field of English translation of Chinese legal texts such as sea-related law. This paper discusses the cases of explicitation in the English version of Maritime Code of People's Republic of China. The authors point out that the literary translation based on classification of explicitation is not suitable for maritime law translation due to their differences in textual characteristics. Moreover, explicitation in maritime law translation is reflected at the levels of linguistic and legal function. The former is similar to that of literature translation; the latter includes expliciation in text format, text feature and text intention.
