论食品安全刑法保护的立法完善

The Criminal Law Protection of Food Safety Legislation

在层出不穷的食品安全事件发生后,食品安全的刑法保护越来越受到重视。自2011年《刑法修正案(八)》颁布以来,刑法对食品安全的立法保护呈趋严之势。但从我国刑法对食品安全类犯罪的规定,特别是对生产、销售有毒、有害食品罪和生产、销售不符合安全标准食品罪这两个食品安全犯罪的本体犯罪的规定来看,食品安全刑法保护仍然存在罪状表述范围过窄、罚金刑设置欠妥、资格刑缺失等立法缺陷,需要从多个方面进行完善。

In the endless food safety incident ,more attention paid to the criminal law protection of food se-curity .Since 2011 , criminal law amendment （eight）” promulgated ,the legislation of criminal law on food safety to protect a trend of tighter .But from the regulation of our country criminal law on food safety crime ,es-pecially crime of producing and selling toxic and harmful food and the production ,the sale is not in conformity with the safety standards of food crime both the regulation of food safety crime essence ,food safety protection still exists such crimes too narrow scope of criminal law ,the fine punishment is set to be inappropriate ,lack of qualification penalty ,such as legislative defects ,need to improve from several aspects .
