摘要
本文通过对有关过劳死一系列问题的关注,考察过劳死及过劳自杀死在日本被认定为工伤事故且认定条件不断科学化、人性化的发展进程,分析其中的主要经验教训,关注《过劳死预防基本法》可能在日本出台的最新动态。鉴于过劳死问题在我国日益严重的现状,建议我国政府一方面应作为预防过劳死的主导力量着手制定过劳死预防的宏观对策,一方面为维护过劳死员工的权益应尽早解决我国过劳死的工伤认定问题,并将其作为改革和完善工伤保险制度的重要突破口。
Based on a series of issues related to Karoshi, the paper explores the developmental process characterized with scientifieafion and humanization of the Karoshi aflSrmed as a type of occupational injury, analyzing experiences and the new change of the enactment of Fundamental Law of Karoshi Prevention. As an ever- exacerbating problem in China, the paper suggests that Chinese government should play the chief role in avoiding Karoshi, making policies. On the one hand, the issue of legal affirmation should be coped with for protecting vicitms' fights. On the other, this is also a breakthrough for the further reform and amelioration of labour law system.
