地方金融立法的发展与创新

Development and Innovation of Local Financial Legislation

地方金融立法是指地方为了调整地方金融关系和金融监管关系而制定的地方性法规。地方立法机关在制定地方金融立法的过程中,要始终坚持地方金融立法的指导思想。改革开放后,我国颁布了一系列金融法律规范以调整金融市场关系。地方金融立法的创新主要有以下几个措施:划分地方金融立法权;加强地方金融立法的创新;健全较为完备的执法人员队伍;建立有序的金融监管体系。

Loeal finaneial legislation refers to the formulation of loeal regulations in order to adjust the relations between loeal finaneial and finaneial supervision. The loeal legislative bodies must always keep in mind the guiding ideology of loeal finaneial legislation during making loeal finaneial legislation. After the reform and opening up,Chi-na has promulgated a series of finaneial laws and regulations to regulate relations of finaneial markets. Taking Shanghai’s finaneial legislation as example,and making the time when China’s shift from planned eeonomy system to soeialist market system as the demareation point,this paper studies the status of loeal finaneial legislation in the same plaee at different periods of time. The following measures are mainly taken in the innovation of loeal finaneial legislation：dividing the right of loeal finaneial legislation;strengthening the innovation of loeal finaneial legislation;perfeeting the eomparatively eomplete law enforeement personnel team and establishing an orderly system of finan-eial regulation.
