我国离婚财产分割研究

Research on Chinese Divorce Division Property

我国目前的离婚财产分割存在分割原则的抽象化、可分割财产的有限性、家务劳动评价的不一致性等问题。对此可结合美国、德国的司法实践,采用公平理念进行财产分割,扩大可分割财产的范围、充分评价家务劳动、考虑人力资本增值因素、子女的年龄段以及现有生活水平。

There are problems existing in sueh as abstract principles,limited division of property,housework evaluation inconsistency. Through researching on legislative and judicial practice in the United States and Germany,the author thinks that China should utilize the fair idea to divide divorce property,expand the scope of divorce division of property,full evaluate of the housework,consider the factors of human capital appreciation,the ages of children and the carrent standard of living.
