论司法考试与法学本科教学的融通——从一项关于司法考试通过情况的调查谈起

On Judicial Examination and the Law Teaching of Undergraduate Course——Based on a Judicial Examination Investigation

通过调查发现法学本科教学存在诸多问题:法学本科毕业生就业方向凸显出法科学生法治信仰的匮乏;法学本科学生急功近利地注重通过司法考试,希望教师在教学过程中围绕司法考试大纲的要求授课讲解,忽略了法学本科教学的教学目标。为了使司法考试与法学本科教学充分融通,高校应注重培养法科学生的法治信仰,法学本科教育不能以司法考试为指挥棒,地方高校法学专业应拟定具有特色的法学人才培养方案。

By an investigation , we find some problems should be paid more attention to . Firstly , the employment structure shows that the law students have less belief in the rule of law . They hope that the teachers should only and mainly teach them with a view to pass the judicial examination , and ignore the instructional objectives of law teaching . To coordinate judicial examination and the law teaching , the author presents three suggestions . Firstly , colleges and universities should pay more attention to cultivating students＇belief in the rule of law of the law students . Secondly , we should set up the concept that undergraduate education of law is not to the baton of the judicial examination . Finally , local university legal science should improve special talent training scheme of law .
