地方立法权问题折射的是中央与地方关系从权力配置观念向双层权力与权利观念的转变,其背后的话语是公民权利。在“依法治国,建立社会主义法治国家”的宪政背景下,地方立法制度既维护中央的权威,保障地方的自主性,更符合人民主权的原则。

The issues of local legislative power reflect the changes in the concepts of right in the dual system of power between the central and the local. Under the background of constitutional government, namely “ruling the country by law, building a socialist country ruled by law”, not only could local legislative system maintain the central authority and the local autonomy, but also is more in line with the principle of people ’s sovereignty.
