论推迟法官退休年龄

On Postponement of the Retirement Age of Judges

在英美法系国家推迟法官退休年龄早已司空见惯,并有完善的制度与之相配套。我国诸多学者对此问题在理论上虽已有深入研究,但司法实务界对此仍存在很大争议。现阶段我国没有推迟法官退休年龄的相关法律法规,同时,还存在我国法官综合素质较低、法官职业化程度低以及其他推迟法官退休年龄的现实难题。因此,有必要从构建科学的推迟法官退休年龄制度、临时实施法官返聘制、提高我国法官职业化水平等方面进行探讨。

In countries like Britain,American and France,it is quite common to postpone the re-tirement age of j udges and they have sound corresponding systems to manage it.In China,many scholars have long considering this issue,but there have much controversy in China’s judicial practice.At the present stage,China has not the relevant laws and regulations.Meanwhile,there are some actual problems concerning the postponement of the retirement age of j udges,such as the overall poor qualifications of j udies and the low level of professionalism.Therefore,it is nec-essary to discuss such suggestions as construction of a scientific system for postponement of re-tirement age of j udges,a system of temporary employment of retire j udges and improvement of the level of professionalism of j udges.
