摘要
特定原则是引渡的基本原则之一,特定原则要求被引渡人不因引渡请求以外的犯罪被审判或执行刑罚,对于被请求引渡人的人权保障具有重要意义。本文对引渡特定原则的内涵进行界定,解释其排除适用的例外情况,并分析引渡制度中特定原则的发展趋势。
The rule of specialty is one of the basic principles of extradition, which provides that a person extradited may not be prosecuted or sentenced for an offence committed prior to extradition other than that for which he or she was extradited, and of great significance for protection of humanity rights. This article explained the contents and exceptions of this rule, and introduced its developing trend in the extradition system.
