摘要
我国在19世纪末20世纪初引入西方大学制度后,在章程建设方面做了颇多有益探索。本文从历史的角度,研究了这一时期国立大学、私立大学以及教会大学的章程,分析、归纳了这些章程在理念与宗旨、内部治理结构、师生权利等方面的比较性特征。其对我国当今大学制定章程的启示为:大学章程要重视大学理念;不能照搬照抄域外模式;要注重对师生权利的规定性;要体现本校的历史传统与特色。
After the introduction of western university systems in the late 19 th century and the early 20 th century,the universities in our country have made much beneficial explorations in statute construction. From the historical view,this paper studies the statutes of the national,private and Christian universities during the period of the Republic of China and analyses the comparative features of the ideal and principles,the internal government structures and the rights of teachers and students in these statutes. The paper also concludes four implications for statute making nowadays. Firstly,university statutes should lay emphasis on university ideal and principles. Secondly,foreign statute models cannot be copied blindly. Thirdly,statutes should regulate the right of teachers and students. Last but not the least,the historical traditions and distinctive features of the university itself should be manifested properly in the statute.
