性倾向歧视纠偏的宪法逻辑:以加拿大为例

摘要 平等权写入加拿大宪法的时间虽不长,但已成为司法审查各种嫌疑归类的最高依据。安德鲁斯案是联邦最高法院对宪法平等权及歧视嫌疑进行的第一次梳理,而由男同性恋、女同性恋等以性倾向歧视提起的系列案件,为宪法平等权的整体解读提供了独特视角。基于对关键性案件判决的考察,不难发现加拿大司法机关在纠偏过程中的宪法逻辑。在开放与保守之间对性倾向群体由歧视到平等的转变最终得以实现,为宪法的实施作了最好的注脚。 Although the equality right written into the Canadian Constitution was not long,it has been as the supreme judicial basis for the review of the various suspected classification.The Andrews v.Law Society of British Columbia was the first combing of the constitutional right of equality and discrimination suspicion by the Federal Supreme Court.Then,a series of cases had been prosecuted by gay men and lesbians for sexual orientation discrimination,which offer a unique perspective for the overall interpretation of the constitutional right of equality.Studying on the judgments of key cases,it is not difficult to find the constitutional logic of Canadian judicial organs during the corrective process.Between the open and conservative,the change from discrimination to the equal of sexual orientation finally achieved,which is the best footnote for the enforcement of the constitution.
