摘要
美洲殖民地在独立战争前的政治诉求,导致了当时英帝国的宪政危机。作为下议院议员的柏克,对此提出了一套政治解决方案,却因各种原因失败了。对柏克的失败原因进行分析,可以发现其局限性不仅仅在于具体方案的不完备,还在于其受制于历史情势的深刻变更。这场变更不仅揭示了旧的英国秩序的困境,也预示着美国宪政秩序的到来。
The situation and political appeals of the American colonies led to the constitutional crisis of the British Empire. Edmund Burke,as a member of the Parliament,proposed a bill under which the crisis was supposed to be defused,but turned out to fail. The limitation of Burke was not only for the incomplete concrete scheme,but also due to the restrictions of the profound historical change. As revealing the plight of the old order of British,this change also heralded the arrival of the American constitutional order.
