摘要
土地利用二元体系传达了限制土地所有权、保障土地利用自由以及利用权中心化的物权观念。在规制"小产权房"问题上,应秉承物尽其用的理念,构建农民宅基地使用权自由处分制度,从宽认可相关交易主体的债权利益,畅通土地的债权利用权向物权利用权转化的机制。
The land's binary-utilizing system expresses the following property notions,such as limiting land ownership,securing the free land utilization and centralization of the use right of land. When regulating the problem of houses with limited property rights,the idea of making the best use of things shall be accepted,namely,the following systems shall be established :farmers shall be allowed to transfer the use right of residential land without limitations;the related counterparties' debt right and interests shall be admitted leniently;the obligation-disposition right could be transformed as the land-use right.
