摘要
西夏立国西陲,崇奉佛教,深受佛教文化影响。在《天盛改旧新定律令》(以下简称《天盛律令》)中不但专为宗教立法,相当多的内容还体现佛教戒律痕迹。结合出土佛教发愿文可以得知,佛教戒律对西夏司法产生了广泛影响。西夏法律在引入佛教戒律的同时对其进行了改造,呈现出彼此影响、相互适应的关系。
In the Tangut Dynasty Buddhism has played an important role. We can see the shadow of Buddhism in secular life. In the document of Tian Sheng, not only designed for religious legislation, quite a lot of content is also reflected traces of Buddhist precepts. Consulting unearthed Buddhist texts it can be learned that Buddhist Disciplines brought profound influence on Tangut judicial system. Buddhist disciplines also were reformed while it has influenced Tangut judicial system, showing the relation of mutual influence and adaptation.
