中华人民共和国电子商务法草案建议稿

Electronic Commerce Law Draft Proposal of the People's Republic of China

电子商务法是中国当前最为重要的立法任务之一。2004年颁布的《中户人民共和国电子签名法》显然不适合当今中国电子商务的发展情况,然而全新的电子商务法框架体系如何架构,基本制度如何确立与衔接,都成为摆在学界和立法界的难题。建议稿立足于国内电子商务发展的基本情况,借鉴了美欧日德韩等国家的先进立法经验,第一次明确提出了我国电子商务法的立法体系,并条文化为建议稿,以供学术探讨和立法参考。

At present,electronic commerce law is one of the most important legislative task in China. ＂Electronic Signature Law of the People＇s Republic of China ＂which is promulgated in 2004 is obviously not suitable for the development of China＇s electronic commerce. One of the problems in academia and legislative circle is how to construct the new framework of electronic commerce law and establish and connect the basic system. The proposal is based on the domestic development of electronic commerce and uses the advanced legislative experience of other countries such as America,Europe,Japan,Germany and South Korea for reference. It definitely puts forward the legislative system of China＇s electronic commerce law for the first time and makes a draft proposal so as to provide a legislative reference and academic discussion.
