互联网服务提供者的义务与责任——以《德国电信媒体法》为视角

The Obligations and Liabilities of Internet Service Providers:Based on Telemedia Law in Germany

《德国电信媒体法》是世界上最早针对互联网服务制定的单行立法之一。该法重点规定了互联网服务提供者应履行的义务。这些义务可以分为两类:一类是服务提供者的信息披露义务。这类义务又可进一步分为一般信息披露义务和特别信息披露义务。另一类是服务提供者对用户数据保护的义务。同时,该法还明确规定了违反义务应承担的责任。这些义务和责任的规定有助于互联网使用者权益的保护。德国的立法实践对我国当下加强互联网立法有着特别重要的借鉴意义。

Telemedia Law in Germany is one of the earliest separate legislation for internet services in the world. It mainly focuses on the obligations of internet service providers. These obligations of internet service providers can be divided into two types： one type is the obligation of the disclosure of information,which can be further divided into the obligation of the general information disclosure and the obligation of the special information disclosure; the other type is the obligation of the protection of the user data. Besides,it stipulates clearly the liability of internet service providers if they violate their obligations. These rules of obligations and liabilities help to the protect the rights and interests of internet users. The practice of the legislation in Germany has important reference meanings to strengthening the legislation of internet services in our country.
