汉语法律条文中“的”字结构的翻译

On the Translation of the Sentences with De in Chinese Legal Provisions

"的"字结构作为现代汉语的特色句式在法律文本中高频出现,对其结构的正确分析、内涵的准确理解和精确翻译是法律文本翻译质量的重要保证。基于中国刑法、合同法及英文译本,根据现代汉语"的"字结构理论,结合法律规范的逻辑结构和法律条文实例分析,不难发现运用词语结构、不定式、介词短语、分词结构以及状语从句等来实现"的"字结构的英译规律。辩证分析美国宪法的中文译本,可知法律英语中的条件句大部分可以转换为法律汉语中表示适用条件的"的"字结构。

The sentences with De are distinctive in modern Chinese language,and they also appear in legal documents with high frequency. Only to analyze their structures properly,to understand their meanings correctly and to translate them accurately can the translation quality be guaranteed. Based on the English versions of The Criminal Law of the People＇s Republic of China and the Contract Law of the People＇s Republic of China,with the Chinese theory of the sentences with De,by analyzing the inner logic of the legal provisions,it can be concluded without much difficulty that the sentences with De can be translated into English phrases,infinitives,prepositional phrases,participles,as well as adverbial clauses,etc. In addition,based on the Chinese version of the Constitution of the United States of America,a conclusion can be drawn dialectically that most of the conditional sentences in legal English can be translated into Chinese sentences with De,indicating the conditions that can be applied to in legal provisions. By using the sentences with De,the Chinese translation for the legal English can be more native and concise.
