公安机关侦办暴力案件涉法医学鉴定中存在的问题及其对策

On the Existing Problems and Countermeasures of Violence Cases with Forensic Identification Handled by Public Security Organs

凡涉及人身伤害的各种暴力案件,都应当依法进行鉴定。本文在深入阐释公安机关侦办暴力案件而涉及人体损伤程度鉴定中所存在的问题基础上,提出了鉴定资料应当由办案部门收集、调取,公安机关侦办案件需要鉴定的应当由公安机关指派、聘请或者委托鉴定,暴力案件应当进行伤情鉴定,用作证据使用的鉴定意见必须告知被鉴定人或犯罪嫌疑人等几方面的对策建议。
