试论完善我国南海政策的对策建议——以国际法为视角

Countermeasure to Perfect China's South Sea Policy:From the Perspective of International Law

从上世纪90年代起,我国政府一直奉行"主权属我、和谈解决、搁置争议、共同开发"的南海政策。我国的南海政策对维持南海地区的和平与稳定发挥了重要作用,但在维护国家主权与海洋权益方面绩效不佳。另外,目前的南海局势使得我国的南海政策难以为继。因此,我国有必要依据国际法考虑从以下三个方面完善南海政策:第一,加强对南海的有效管辖;第二,灵活选择解决南海争端的途径与方法;第三,加大对南海海洋资源的开发与保护力度。

China advocated the South Sea Policy：“sovereignty belonging to China,peace negotiations,shelving territory sovereignty dispute and joint development”the 1990＇s.However,the police did not safeguard our national sovereignty and sea interests in recent years.So,we should perfect China＇s South Sea Policy in accord with international law.Firstly,China should strengthen effectively control of South China Sea.Secondly,China should settle the South China Sea disputes more flexibly.Finally,China should impel the exploitation and protection of marine resources in the South China Sea.
