政府信息公开中的律师调查取证权,一方面是公民一般权利和法律特许权利的综合体,这种综合性决定了该项权利在不同的条件下有不同的效力;另一方面,政府信息是各项权利的记载,知情权与隐私权在各类政府信息中的权重不同,律师调查取证权也因此有着实现程度上的差别。本文以三类政府登记信息为例,探讨律师调查取证权的实现及其限度。

Counsel＇s right to investigate and collect evidence in the government information publicity, on one hand, the right is a complex of general citizenship rights and special legal right. Such kind of comprehensive leads to different effect under different conditions. On the other hand, government information is records of all kinds of rights, in which right to know and privacy has different proportion. Therefore, counsel＇s right to investigate and collect evidence has different limits. This article discusses implementation and limit of counsel＇s right to investigate and collect evidence in three different government information.
