论我国政府行政决策法治化的基本范畴 被引量:1

摘要 在我国,政府行政决策具有特殊性,往往关涉全局抑或区域。结合我国政府行政决策的运行特点和行政权力的历史惯性,希冀提升政府行政决策的安全性和可靠性,即须以科学性、民主性和规范性的法治化为基本制度保障;而决策的科学性、民主性和规范性又须以坚实透明、有机交融的高层协商民主和草根协商民主为前提条件。政府行政决策法治建设的重点离不开"三结合决策机制"的法治化,即着力夯实从国家到地方的各个层次的"公众参与、专家论证和政府决定相结合"的行政决策制度体系。唯有社会力量的有序介入和社会智慧的有效植入,才能使得政府行政决策的安全性和可靠性获得制度性的保证。 In China,government administrative decision-making has its particularities,as it is often concerned with either the whole country or a specific region. Against the backdrop of the operational characteristics of administrative decision-making and historical inertia of administrative powers in China,to raise the safety of government decision-making,we must set up a basic and law-based institutional guarantee that is scientific,democratic,and standard on the premise of transparency and integrated high-level and grassroots deliberative democracy. The law-based administrative decision-making process must be based on a law-based mechanism that includes 'public participation,expert evaluation,and government decision'. Effective involvement of wisdoms from the public and non-government sectors helps ensure the safety and reliability of government administrative decision-makings.
