对“传播淫秽物品行为”的民众态度调查

对传播淫秽物品行为的民众态度进行调查分析是为了给传播淫秽物品犯罪立法政策提供素材和依据。采用问卷调查法,以大学生、城市、农村居民为对象展开调查结果显示,对网上散布淫秽图片行为,认为现行法处罚适当占12.5%,处罚过重87.5%。赞成处罚的主要理由是破坏道德风气、保护未成年人。不赞成处罚的理由是成人观看者主动自愿,不会对其产生巨大影响。对传播淫秽物品牟利罪,认为现行法适当15.7%,八成以上认为处罚过重。处罚理由是保护未成年人、维持道德和网络环境。不处罚理由是双方自愿参与、未侵害他人利益,成年人有性自由权。从调查结论可以看出,民众对此类行为多数倾向于不处罚或行政处罚,这与现行法追究刑事责任的规定并不一致。

Objectives analyse the investigation of people opinions for disseminating obscene articles,and provide the foundation for the criminal legitimation policy on the activities. Means Adopt the method of questionnaire survey, object to investigate for college students,urban and rural residents. Results As for the activities of disseminating obscene pictures through the Internet,in view of the act that is contrary to the morality, and protection of juveniles,12.5% individuals consider that punishment of positive law is advisable.Nevertheless,the other hold the opposite opinion.As far as they concerned,adult-viewers are willing to glance over, also,it cannot engender a huge impact. With respect to crime of disseminating obscene articles for profit-making,15.7% of people consider that punishment of positive law is appropriate.However, there are still over 80% believe that it is so serious.Otherwise,the assentors hold the same reasons above. Conclusion Populace tend to spare the rod or administrative penalty, it does not come with the regulation and criminal responsibility.The social negative attitude,which is formed by moral concepts,right consciousness,the conception of human natural,and the development of technology and medical science,and etc.
