标准必要专利与我国企业策略研究

Study on Standards Essential Patents and Enterprise Strategy of China

对标准必要专利的研究对我国专利与技术标准战略的构建与协同发展具有理论与现实的指引作用。在对标准必要专利界定与特征概括的基础上,针对国际上主要标准化组织标准必要专利数据库的研究,提出了基于现有数据库开展标准必要专利统计分析的思路,并针对中国企业提出标准必要专利策略性建议,引导中国企业积极有效地参与国际标准必要专利竞争。

The study on the Standards Essential Patents （SEPs） can make great contributions to not only the theory, but also real practice of the establishment and development of China＇s intellectual property and technical standard collaborative strategy. On the basis of interpretations of SEPs, the typical characteristics of SEPs have been generalized. Regarding to the development status of SEPs, a comprehensive research on the portals of SEPs＇ data bases provides a useful tool to do research based on patentometrics, even though these bases still requires much improvement in format and accuracy. The suggestions about SEPs, especially for Chinese enterprises, would undoubtedly conduce to the positive and effective attendance and practice of Chinese enterprises in the international competition of standards essential patents.
