国家治理价值体系现代化与行政法学理论基础的重构——以“诸神之争”为背景的分析

Modernization of State Governance Value System and Reconstruction of Administrative Law Theoretical Basis——Analysis Under Background of ‘Gods' War'

国家治理体系包括"道"和"术"两大内容,"道的现代化"和"术的现代化"则是国家治理体系的现代化建设的两大根本目标。其中"道的现代化"是整个国家治理体系基础所系。"诸神之争"是中国"道的现代化"面临的历史情境。无论是"决断"还是"商谈"都无法化解诸神之争,以合作作为价值共识却可以解决这一问题。现代国家治理应该最大程度地的促进社会合作,提升社会合作的水平。法律既不应该以权利为本位,也不应该以义务为本位,而是应该以合作为本位。行政法既不是控权法,也不是平衡法,它应该是构建、保障和修复良性官民合作关系的法。

Since the state governance system contains two major contents of ‘Tao’ and ‘Shu’, the ‘modernization of Tao’ and the ‘modernization of Shu’ become the two fundamental goals of the modernization construction of the state governance system. Between them, the ‘modernization of Tao’ is the basis. The ‘Gods’ War’ was the historical context of the situation that China’s ‘modernization of Tao’ facing now. Neither breaking up nor negotiation can solve the war, but cooperation can. Consequently, modern state governance should promote social cooperation greatly in order to improve the cooperation level. Neither right and interest nor obligation but cooperation should be the basis of law. Hence the administrative law should not focus on power control or relationship balance, but it should be the law providing benign ofifcials and the public cooperation relationship with construction, guarantee and repair.
