Political and Systematic Guarantee for the Independent Exercise of Judicial Right and Procuratorial Right in Accordance with Law

依法独立公正行使审判权、检察权是司法体制改革的核心内容,是法治中国建设进程中必须切实加以解决的司法权运行的基础性问题。依法独立公正行使审判权、检察权的实现,党的领导是政治保障;深化司法体制改革,建设公正高效权威的社会主义司法制度是制度保障。两大保障体系的建设应当齐头并进,不可错置和偏移。政治保障要从坚持和改善党的领导入手,制度保障要从司法管理体制、司法人员管理制度、落实司法责任、推进阳光司法、加强监督机制等方面发力,共同筑成依法独立公正行使审判权、检察权的保障体系。

The independent exercise of judicature right and prosecuting right according to law is the rudimentary content of justice sys-tem reform and also the basic issue of judicial right operation in the process of building China ruled by law. For the realization of the in-dependent exercise of judicature right and prosecuting right according to law, the Party’ s leading is the political guarantee; for the deepening of justice reform, the building of fair, effective and authoritative socialist judicial system is the system guarantee. The two systems should advance together. Political guarantee should start from strengthening and improving the leadership of the Party and sys-tematic guarantee should start from the reformation of the judicial system, judicial personnel management system, judicial responsibility implementation, fair justice promotion and supervision mechanism, in order to construct the guarantee system of independent exercise of judicature right and prosecuting right according to law.
