检察机关适用非法证据排除规则若干问题探讨——兼论《人民检察院刑事诉讼规则(试行)》修改的意见和建议

On Several Issues of Application of Illegal Evidence Exclusive Rule for Procuratorates

从《人民检察院刑事诉讼规则(试行)》(后简称《规则》)的规范文本分析,检察机关的非法证据排除在审查逮捕和审查起诉环节都有排除的职责,程序的启动主要来自于两个方面,一是依职权启动;一是依申请启动。而排除的范围不仅限于言词证据,还包括实物证据。就《规则》规定而言,当前涉及到的"刑讯逼供等其他非法方法"的解释应当进一步细化,对于疲劳审讯,威胁、引诱和欺骗以及重复性自白问题应当有所明确,对于瑕疵证据的"合理解释"也应当进一步明确"充分性"的限制条件。

By analyzing of the normative text of ＂the people＇s procuratorate criminal procedure rules （trial）＂ （later referred to as ＂the Rules＂ ） ,the procuratorates have the duties of illegal evidence exclusion during the phases of review of arrest and prosecution. Initiating this procedure stems from power and Application. The scope of exclusion is not only limited to the testimonial evidence, but the physical evidence. As the provisions of ＂ the Rules＂ are concerned, the explanation currently involved the ＂torture and other illegal methods＂ should be further refined. The issues on the fatigue interrogation, threats, enticement and deception as well as repetitive confessional should be clear. It should clarify the ＂adequacy＂ of the restrictions for ＂reasonable interpretation＂ of defect evidence.
