人有无生命自主处分的权利是现代民主国家歧义很深但又无法回避的沉甸法治话题。在生命神圣标语逐渐消退宗教神学色彩的历史进程中,民众日益关注、重视生命的品质,无论是基于人的尊严的核心价值发掘生命权的实质内涵,还是通过找寻自我决定权的权属位置肯认生命自主权的法律存在,在一个人自由、自愿、真挚的主观状态下,自主处分、结束自己的生命,是个人主义价值倍受尊崇的国家社会中理性而务实的时代回应。

Whether one has the right to dispose his life is an unavoidable important theme in modern democratic society. With the development of history along with the dismiss of the sanctity of life, the people pay more attention to the quality of life. Whether base on the value of human dignity and the true definition of living right, or acknowledge the law exist of self-determination, that one has the right to dispose his life voluntarily and sincerely is the respect of the value of personalism.
