知识产权滥用规制的理论建构新论——以知识产权的自然属性作为逻辑起点的研究

A New Study on The Theory Construction of the Regulation of the Abuse of Intellectual Property Rights

加强知识产权滥用规制基本理论的系统研究,对于提高我国知识产权滥用规制的立法、执法及司法水平具有重要意义。知识产权滥用规制的理论建构应该建立在以下三大基本理论问题的基础之上:第一,知识产权的特质,这是知识产权滥用规制理论的逻辑起点;第二,知识产权滥用的内涵,这是知识产权滥用规制理论的逻辑基础;第三,知识产权滥用规制的法律机制结构,这是知识产权滥用规制理论的逻辑归宿。

To strengthen the systematic research of the basic theory of the regulation of the abuse of intellectual property rights is of great importance to improving legislative level, law enforcement level and judicial level in respect of the regulation of the abuse of intellectual property rights in China. The theory construction of the regulation of the abuse of intellectual property rights should be based on the following core academic issues： first, the features of intellectual property rights, which is the logical origin of the theory; second, the connotation of the abuse of intellectual property rights, which is the logical basis of the theory; third, the legal mechanism of the regulation of the abuse of intellectual property rights, which is the ultimate logical aim of the theory.
