“负面清单”转型经验的国际比较及对中国的借鉴意义

An International Comparison of Transformation Experiences of “Negative List” and its Enlightenment to China

由于区域性或双边条约的推行,很多国家主动或被动地在国内外资法规中采用了"负面清单"模式。但具体规定和做法有明显区别,采用"负面清单"模式的国家在大体形式上达到了国际贸易投资谈判的要求,但往往仍然有很多限制和实质性的障碍。"负面清单"只是朝向更公平的投资竞争环境的重要一步。与国际趋势比较,中国目前在上海自由贸易试验区试行的负面清单模式存在一些问题,需要进一步改进。

Many countries have adopted the Negative List model in their foreign investment admissions because of the requirements from bilateral or regional treaty negotiations. But,their routes towards the Negative List differ a lot, especially on their implementation ways,and there still exist a lot of restrictions and barriers. The Negative List reform is just one of the most important steps towards fairer competition environment. Compared with the international common practices, China’s current Negative List model in Shanghai Pilot Free Trade Zone（PFTZ） still needs to clarify some issues.
