计量法学的学科发展史研究——兼论我国法学定量研究的着力点

Research on the Evolutional History of Jurimetrics——With Additional Study on the Point of China's Quantitative Research

在实证研究的理论、思维和方法技术发展的影响下,作为学科的计量法学应运而生,其生长历程经历了萌芽、发展和分野三个阶段。它在萌芽阶段的内容主要是符号逻辑的运用、法律现象数据库的建立和运用以及法官行为和判决预测。计量法学的形成阶段主要是判决预测和制度评价;其以数据建模为方式,对各种法律现象进行实证分析的方法也得以确立。在发展阶段中,计量法学的判决预测论和数据论证领域有了新的研究视角和方法。中国目前学界和实务界都缺乏定量研究,而计量法学对立法、司法和数据库的建立三个方面的发展都能起到重要的作用。

Under the influence of the theory, thinking mode and the development of the method and technique of demonstrative study, Measure Law as an independent discipline originates and can be divided into three stages： germination, development, separating. The main content of the germination stage is calculation of logic of sign, the establishment and calculation of the data of legal phenomenon and the conduct of the judge and the prediction of the sentence. The development state is about the prediction of the sentence and the evaluation of the system and it becomes a discipline in the sense of methodology. At the state of separating from traditional law, the data demonstration field succeeds in separation and there is new development in the prediction of the conduct of the judge.Chinese academic and practical circle lack quantitative study and measure law plays important role in prediction of sentence, evaluation of system and data demonstration.
