我国环境法理论更新与制度完善——基于生态文明视域

Renewal of Chinese Environmental Law Theory and the Perfection of the System——In the View of Ecological Civilization

生态文明的提出,是我国经济社会发展的要求,也是时代发展的要求。生态文明的理念为我国经济社会发展指出了一条健康、有序发展的道路。这条道路的通达,需要对现有的环境法理论基础进行革新,并在此基础上,不断地建立健全各项制度体系,完善各项法律制度,加强体制机制的改革。环境法作为法律体系中的重要一部分,理应为生态文明的实现做出自己的贡献。从环境法指导理念的转变,到法律原则的变化,再到立法模式和法律体系的今后发展方向,我国环境法的发展要始终围绕着生态文明这个主旨。虽然我国的环境法仍存在很多不足与缺陷,但是通过不断的修正与完善,结合我国的政治、经济、文化与社会的实际情况,不断健全相应的法律体系,从而更好地保护我国的生态环境。

Proposed ecological civilization is the requirement of China ’s economic and social development , but also the requirements of the times .Concept of ecological civilization for our country ’s economic and social development indicates a path of healthy and orderly development .Mastery of this road needs for the existing theoretical foundation to innovate environmental law ,and on this basis ,we should continue to establish and improve the institutional system ,improve the legal system ,and strengthen the institutional reform .Environmental law as an important part of the legal system ,should make its ow n contribution to achieve ecological civilization .Changes in environmental law from the guiding philosophy of the change in legal principles ,the future direction of development mode and then legislative and legal system ,all reflect that the development of our country’s environmental law has always been around the theme of ecological civilization .Although our country’s environmental law s still have many deficiencies and defects ,through continuous revision and improvement ,combined with our country’s actual situation of the political ,economic ,cultural and social condition ,the appropriate legal system will continue to improve so that we can better protect ecological environment .
