网络隐私权侵权及其法律规制的思考

互联网在给人们的工作、学习和生活带来巨大便利的同时,也使个人网络隐私数据信息被泄露,侵权现象严重,网络隐私权的法律保护面临挑战。而要对网络隐私权侵权进行有效法律规制,首先得把握网络隐私权权利属性、法律特征,了解网络隐私权的侵权状态、侵害原因和其他国家的规范策略,并在此基础上,以一种尽量全面的视角视角,采采取"立法规制为主、行业自律为辅、自我提升为本"的综合保护模式,实现我国网络隐私权的权利保护,达到网络隐私权维护和网络产业发展的双赢目的。

Though the Internet brings much convenience to our work, study and daily life, the personal information in the Internet is disclosed frequently. Infringing cases become ordinary affairs. It is a challenge to the legal protection of the Internet privacy infringements. In order to get the effective legal regulations of the Internet privacy infringements, its right attribute, legal characteristics, status and causes of infringements and policies and regulations in others countries should be understood. What＇ s more, an overall view is needed to realize the legal protection of the Internet privacy by means of a comprehensive protection mode, that is, taking legislative regulation as the main method, industry self- regulation as the supplement and self-improvement as the essence, as to make a win-win result to maintain the Internet privacy and develop the Internet industry.
