完善我国现代物流法律制度的思考

我国现行物流法律制度存在诸多问题,如系统性、协调性不够,效力较低,仍有不少法律"真空地带",滞后于物流业发展展,物流技术标准不统一等。应借鉴美国的立法经验,加强国家对物流产业的宏观调控,完善物流行业协会和组织的监管,营造适合本国物流发展的政策环境。最后,文章提出了整合现有物流法律规范、实现现代物流技术标准法律化、对物流活动进行统一立法等建议,以期为完善我国现代物流产业法律制度提供借鉴。

At present, there are so many problems in logistics legal system of China, such as insufficient systematization and coordination, low efficiency, many legal vacua, a lagging behind the development of logistics industry, and disunity of logistics technology standards. Therefore, we can learn the legislative experience from USA, strengthen the national macrocontrol of the logistics industry, and improve the supervision of the logistics industry associations and organizations as to create a suitable policy environment for our own logistics development. The suggestion of our research group is to integrate the logistics of existing laws and regulations, unite the law of modern logistics technology and create a law for logistics activities in order to perfect the legal system of modern logistics industry in China.
