转基因生物损害赔偿制度初论

Research on Compensation System of GMO Damage

转基因生物损害主要包括对环境的损害和对人体健康的损害,其与传统环境损害具有显著区别,具有广泛性、持续性、潜在性、缓慢性、多元参与性等特征,转基因生物损害赔偿的制度的建立是整个立法的保障,而我国在转基因生物损害赔偿制度上的研究和立法都比较薄弱,尚达不到对转基因生物损害进行充分救济的水平。有必要对转基因生物损害赔偿的基本问题如损害赔偿的基本原则、法律框架的完善展开研究,并顺应国际转基因生物损失赔偿国际立法的情势,确立财政担保规则,建立与《名古屋—吉隆坡补充议定书》相衔接制度。

The damage of GMO includes damage of the environment and human health. Compared with traditionalenvironmental damage, it has significant differences, such as being universal, persistent, potential, pluralisticparticipatory and so on. GMO damages system was a protection to the entire legislation, and our GMO damages ininstitutional research and legislation are relatively weak, which fail to get to the level of GMO＇s damage relief. It isnecessary to study on basic issues such as basic principles of damages, the legal framework and adapt to the situation ofinternational genetically modified organisms damages international legislation turn, and then establish financial securityrules, and convergence system with the Nagoya-Kuala Lumpur Supplementary Protocol.
