论《汉书·刑法志》所见之正统史观

On the Historical Orthodoxy in Criminal Annals of Han Book

本论首先概述正统史观,再以《汉书·刑法志》为切入点,通过分析班固对汉及以前之兵刑制度史的撰述,从国家政权与法同源于天、王朝嬗递与兵刑继受、国家治乱与礼刑秩序三个层面解构蕴含于《刑法志》中的正统史观与法律观念,并以宽恕历史为基点再评正统论。

The paper introduces the general description of historical orthodoxy and analyzes Ban Gu＇s presentation in Criminal Annals about the history of military and penalty system before the Han Dynasty. Then the paper deconstructs the historical ortho- doxy and legal conception contained in Criminal Annals from three perspectives： state authority and legal equally originated from God, dynasty evolution and the inspiring between ancient military and penalty, state ruling under rites and order sustained by rites and penalty. The paper also provides a review on the historical Orthodoxy with a tolerant attitude.
