授权立法的合法性监督比较研究

A Comparative Study of the Legitimacy Supervision of Authorized Legislation

对授权立法进行合法性规制,除了以"授权明确性"原则进行初步制约外,行政机关经授权制定之法规范,尚需其他监督机制,以避免行政机关的恣意滥权。这主要包括立法机关对授权立法的监督以及司法机关对授权立法的审查。通过比较法视野的研究,可以完善我国对授权立法的立法监督和司法审查机制,使我国授权立法更好地发挥作用。

There should be many other ways to regulate the authorized legislation made by administrative organs besides the principle of ＂explicit authorization＂, to prevent the authorized agency abusing of power. It main includes the legislative supervision and judicial review. Through the study of comparative law perspective, we can improve our legislative supervision and judicial review of the authorized legislation. Only in this way, can our authorized legislation play a role of developing of our society.
