本文针对一起办理医疗机构使用未取得护士执业证书人员从事护理活动案如何适用法律带来的困惑进行分析、讨论,提出解决问题的建议,以期对卫生监督执法工作能有所帮助并引起医事法学界更多的关注和思考。

This paper firstly discussed the problems and confusions about the application of laws which encountered in the process of an administrative penalty case.In the case,the hospital hired some persons to apply nursing service who had no nurse licenses.This paper try to propose the solutions of this problem and give the suggestions to relevant institutes and persons.
