Establishment and Improvement of Specific Regulations in Ethnic Autonomous Areas

民族自治地方应当依法制定单行条例;单行条例是民族自治地方行使自治权的一种主要法规形式,它只能以自治权限的范围为依据规定相关事项。自治地方单行条例是一项特别的立法授权,是规制地方经济社会发展过程中各种矛盾的有效方式,是民族自治地方民族法制体系建设的重要组成部分。必须完善民族自治地方单行条例的立法决策和程序,建立单行条例实施、适用的法律环境,健全单行条例的立法监督机制,促进自治区单行条例的制定和实施。

Separate regulations should be formulated according to law in ethnic autonomous areas,and they are the major form for the national autonomous areas to exercise the power of autonomy,which can only be executed within the scope of autonomy rights.These specific regulations are a kind of special legislative authorization;as the key elements of constructing the ethnic legal system,they effectively settle the various conflicts in the process of economic and social development in ethnic autonomous areas.Thus,we must ensure that the legislative decisions and procedures be perfected,the applicable law environment be established,together with the legislative supervision system be improved to promote the implementation of autonomous separate regulations.
