摘要
食品安全问题是事关民生的重大问题,对其安全现状进行评估是研究存在问题深层次原因的前提和基础。在当前语境下,食品安全法律失范、食品安全的不守法现象普遍、食品安全的执法乏力、食品安全的司法缺位等是法律治理亟待解决的问题,权大于法导致法律得不到信仰、守法成本高导致不守法、行政权力运行机制导致执法不力等是问题存在的主要原因。为此,运用依法治权树立法律权威、建立守法者受益机制、改革行政权力的运行机制、完善司法管理机制等,是实现食品安全问题法律治理的重要路径选择。
Food safety is a significant livelihood issue. Evaluating the safety situation is the premise and foundation of research on the ex- isting problems of the deep-seated reasons. In the current context, the food safety law anomie, not abiding, law enforcement weakness and judicial vacancy is urgent to solve by legal governance. Power a- bove the law leading to lackness of legal beliefs, law-abiding high cost leading to lawlessness, the administrative power operation mechanism resulting in ineffective enforcement are the main reasons for the existing problems. Therefore, the use of rule of law to estab- lish the legal authority, establishing a law-abiding person benefit mechanism, the reform of the administrative power operation mecha- nism, perfecting the judicial management mechanism are important path choice to solve food security problems by legal management.
