水库淹没农村集镇商业店铺补偿问题的思考——以江西省W水库建设为例

The Idea of Reservoir Flood Rural Town Business Store Compensation——A Case Study on W Reservoir Ronstruction in Jiangxi

以江西省W水库的建设为例,基于对文献的研读以及对W水库准备期间移民安置工作的参与,对在水库建设拆迁安置过程中农村集镇商业店铺的补偿问题进行了一些思考。认为:(1)农村集镇上用于商业经营的店铺在房屋拆迁补偿安置的过程中具有其特殊性,不能将其并入普通农村住宅房屋拆迁的补偿标准,应在此基础上给予细致考量和适当的提高;(2)拆迁"时间差"的问题给当地从事建筑装潢行业的集镇商铺店主带来了机会损失,损失可以通过有关部门的合理评估计算入补偿款内;(3)拆迁农村集镇商业店铺带来的不仅仅是店主有形资产的损失,在某种程度上,无形资产的损失更为严重和深远。

By using W reservoir construction in Jiangxi province as an example,based on the study of litera-ture as well as the participation in the W reservoir resettlement work during the period of preparation,this pa-per take some consideration on the demolition and resettlement in the reservoir construction compensation prob-lem of rural market town business store. This paper holds this opinions as follow：（1）The rural market towns for the commercial stores in the process of housing demolition compensation and resettlement has its particulari-ty,and it should be based on the given careful consideration and appropriate increase ,rather than be incorpo-rated into the ordinary rural residential housing demolition compensation standard;（2）Demolition ＆quot;time lag＆quot;problem for the local architectural decoration industry market town shopkeepers brought opportunity loss,and the loss can be achieved by reasonable assessment of the relevant departments of the calculation into the com-pensation;（3）To some extent,the loss of tangible assets is far more than the losses on tangible assets brought by the demolition and relocation of rural market town commercial shop owner.
