财产权学说是洛克政治哲学的重要组成部分,洛克消极的政治哲学观倡导政府的目的是保护人们的财产,因而财产权就被赋予了政治哲学的意义,成为评判政治权力正当性的道德基础之一。文章研究的主题是洛克财产权学说中关于财产权的限制的问题,从分析这一问题是如何提出的开始,进而探讨了洛克关于财产占有与享用的限制、财产积累的限制等问题,最后阐述了学界关于洛克财产让渡权的争议。

The doctrine of property was the important part of Locke＇ s political philosophy. The Locke＇ s negative view of political philosophy held that the purpose of government was to protect people＇s property, so property was given the meaning of political phi- losophy and became one of the moral basis of tile evaluation of the legitimacy of political power. The theme of tiffs thesis is about the limitation of property in Locke＇ s doctrine of property. It starts with the analysis of how to raise questions, and then discusses several questions of locke on tile limitation of the occupation, usage and accumulation of property, and finally describes the academic dis- putation about Locke＇ s right of alienation.
