科学认定恐怖活动组织与人员,是有效防范、准确打击恐怖活动的前提和基础性工作。世界各国纷纷通过完善反恐立法,构建恐怖活动组织与人员认定机制。我国恐怖活动组织与人员的认定立法还存在一些不足,应该通过立法明确司法认定和行政认定并行的双轨认定模式,完善行政认定程序、制裁措施,并建立认定复核制度,从而完善我国恐怖活动组织与人员的认定机制。
